1. Agreement to Terms

By accessing or using this website (the “Site”) and/or placing an order on the Site, you (“you,” “user,” “customer”) agree to be bound by these Terms & Conditions (“Terms”), as well as our Privacy Policy. If you do not agree to these Terms, please do not access or use the Site or place any orders.

2. Who We Are

The Site is operated by iAMORY- HM Sarafa Bazar India Pvt Ltd (hereafter “we”, “us”, “our”). Our registered corporate address is: Shop 7, Ground Floor Chandivali, Mumbai 400072

3. Definitions

  • Products: Goods listed on the Site, including 925-silver, gold and lab grown diamonds jewellery items sold by iAMORY-HM Sarafa Bazar India Pvt Ltd.

  • Order: A request by you to purchase Products via the Site.

  • Service: Use of the Site for browsing, placing Orders, and any related services (including payment processing, customer support, delivery, returns).

4. Eligibility & Use of Site

  • You represent that you are at least 18 years old, or using the Site under the supervision of a parent or legal guardian.

  • You agree not to use the Site in any unlawful or prohibited manner, including but not limited to misuse, fraud, or infringing others’ rights.

  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Site (content, design, images, text) without our express written permission. All intellectual property rights remain with us or our licensors.

5. Orders, Pricing & Payment

  • All prices displayed on the Site are inclusive of applicable taxes (unless stated otherwise) and in Indian Rupees (₹). We reserve the right to modify prices, offers, or availability of Products at any time before you place an Order.

  • When you place an Order, you agree to pay the full amount, including the price of Products, shipping/delivery charges (if any), and any applicable taxes.

  • Payment must be through payment methods offered on the Site. We may use third-party payment gateways — in such cases, payment processing is subject to their terms. Sensitive payment credentials are handled by the payment gateway, not stored by us.

6. Order Confirmation, Shipment & Delivery

  • Once you place an Order, we will send you an Order confirmation via email, whatsapp or SMS. This confirmation does not necessarily mean we accept your Order — acceptance happens when we dispatch the item.

  • Delivery timelines provided on the Site or at checkout are estimates. We shall not be liable for any delay beyond our control (e.g. courier issues, natural calamities, strikes, force majeure).

  • Risk of loss or damage to products is borne by our insurance provider.

7. Returns, Refunds and Cancellations

  • Our return, refund, and cancellation policy (as published separately on the Site) applies to all Orders. By placing an Order, you agree to that policy.

  • We reserve the right to refuse cancellation or returns in certain cases — e.g. customised jewellery, items damaged due to misuse, or orders delivered beyond return window.

  • Refunds (if applicable) will be processed as per our refund policy and applicable laws / payment-gateway rules.

8. Intellectual Property Rights

  • All content on the Site — including but not limited to text, images, logos, graphics, product descriptions — is owned by iAMORY or licensed to iAMORY and is protected by copyright, trademark, and other intellectual property laws.

  • You may not copy, reproduce, modify, republish, upload, post, transmit or distribute any content from the Site without our prior written consent.

9. Disclaimers & Limitation of Liability

  • We endeavour to provide accurate information about Products (descriptions, images, colours). However, actual appearance may slightly vary (due to screen settings, lighting, metal/tone variation). We do not warrant that product descriptions or other content are completely accurate, error-free or complete.

  • To the maximum extent permitted by law, iAMORY and its affiliates, officers, employees or agents will not be liable for: (a) any indirect, incidental, punitive, or consequential damages; (b) loss of profits; (c) loss or damage of property; (d) any loss arising from use of or inability to use the Site or Products; (e) any claim relating to defects, delays or other issues with Products or delivery.

  • Our total aggregate liability for any claim related to this agreement or the Site will in no event exceed the amount you paid to iAMORY for the relevant order.

10. Indemnification

You agree to indemnify and hold harmless iAMORY, its officers, directors, employees, agents, and affiliates from any claim, liability, loss, damages, costs or expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your misuse of the Site; (c) your violation of laws or rights of third parties.

11. Links to Other Websites

Our Site may contain links to third-party websites, services, or resources for your convenience. We do not control and are not responsible for the content, privacy practices or accuracy of those sites. Use of third-party sites is at your own risk.

12. Modification of Terms / Changes to Site

  • We reserve the right to update, change or modify these Terms at any time, without prior notice. The “Last Updated” date above will reflect the latest version.

  • Your continued use of the Site after changes implies acceptance of the updated Terms. We encourage you to review the Terms periodically.

  • We may also change, suspend, or discontinue any part of the Site (products, features, services) at our discretion, without liability to you.

13. Termination / Suspension of Access

  • We may suspend or terminate your access to the Site (or any part) or cancel your pending Orders at any time, without liability, if you breach these Terms or if we suspect misuse, fraud, or illegal activity.

  • Upon termination, you must cease all use of the Site. Clauses that by their nature should survive termination (e.g. intellectual property, indemnity, disclaimers, limitation of liability) will continue to apply.

14. Governing Law and Dispute Resolution

  • These Terms and your use of the Site shall be governed by the laws of the Republic of India.

  • In case of any dispute, you and iAMORY agree to submit to the exclusive jurisdiction of courts located in Mumbai, Maharashtra, India.

15. Severability, Waiver, Entire Agreement

  • If any provision of these Terms is found invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will remain valid.

  • Our failure to enforce any right or provision under these Terms does not constitute a waiver of such right or provision.

  • These Terms (along with our Privacy Policy, Return/Refund Policy, and any other policies posted on the Site) constitute the entire agreement between you and iAMORY relating to your use of the Site and supersede all prior or contemporaneous communications and proposals (whether electronic, oral or written).
